AnalysTick End-User License Agreement ("EULA")

IMPORTANT: PLEASE READ THIS EULA CAREFULLY. YOUR USE OF THE ANALYSTICK APPLICATION ("APP") CONSTITUTES YOUR ACCEPTANCE OF THIS EULA. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU MAY NOT USE THE APP.

1. General Terms

This EULA governs your use of the App, which is licensed, not sold, to you by MGB Capital Ltd ("Licensor"). The Licensor reserves all rights not expressly granted to you. By using this App, you confirm that you have read, understood, and agreed to be bound by these terms.

2. Scope of License

The license for the App is limited, non-exclusive, non-transferable, and revocable, permitting use only on Apple devices you own or control, in accordance with App Store Usage Rules.

3. Incorporation of Apple's Standard EULA

This EULA incorporates the Standard Apple EULA by reference. In case of conflict, this EULA prevails on matters not explicitly covered by the Standard Apple EULA.

4. Data Sources and Third-Party Provider Agreements

The App obtains and displays market data from third parties. Your use of the data is subject to a separate agreement between you and the data provider, to which the Licensor is not a party and is not liable. You are responsible for complying with the data provider's terms.

5. Data Accuracy, Modification, and Use Disclaimer

5.1 "As Is" Basis: The market data, whether raw or processed by the App's features (e.g., charting tools, analysis, or aggregations), is provided "as is" for informational purposes, without warranties of any kind.
5.2 No Verification: The Licensor is not responsible for errors or omissions in the original data supplied by the provider and has not verified its accuracy.
5.3 Delays and Disruptions: The Licensor is not responsible for any delays, interruptions, or cessation of data transmission that originate from the third-party data provider's systems. Such issues are outside the Licensor's control, and the App's service availability depends entirely on the provider's service.
5.4 No Investment Advice: The Licensor does not offer investment, financial, or tax advice. The App is a tool for data visualization only.
5.5 User Responsibility for Decisions: The Licensor is explicitly not responsible or liable for any investment decisions made by you or any third party based wholly or partly on the data represented within the App. Any such decisions are your sole responsibility, and you assume all risk. You should conduct your own research and consult a qualified financial professional before making investment decisions.

6. Limitation of Liability

To the extent permitted by law, the Licensor is not liable for any direct, indirect, incidental, consequential, or punitive damages, including financial losses or loss of profits, resulting from your use or inability to use the App, or from errors, delays, or disruptions in the market data (whether raw or modified).

7. Indemnification

You agree to indemnify and hold harmless the Licensor against any claims, damages, liabilities, costs, or expenses arising from your use of the App, reliance on its data, or violation of these terms.
